Dear International Scholars,

We are writing to inform you of updated information in regards to the recent U.S. Presidential Proclamation on H-1B Workers effective September 21, 2025. You can read the proclamation in full here. Based on additional information provided by the U.S. federal government, we now know that the Proclamation applies only to H-1B non-immigrant visa petitions that are filed on or after 12:01 a.m. ET on September 21, 2025 for a potential H-1B scholar who is located OUTSIDE of the U.S. and does not have a valid H-1B visa. 

On October 20, 2025, USCIS provided updated information clarifying who is subject to the $100,000 payment, how and when to make the payment, and information regarding exceptions. 

Based on this updated information:

  • The Proclamation applies only to H-1B non-immigrant visa petitions that are filed on or after 12:01 a.m. ET on September 21, 2025.
  • The Proclamation does not apply to: 
    • Foreign nationals who are the beneficiaries of H-1B petitions that were filed prior to 12:01 a.m. ET on September 21, 2025 of the Proclamation.
    • Foreign nationals who are the beneficiaries of currently approved H-1B petitions.
    • Foreign nationals who are in possession of validly issued H-1B non-immigrant visas.
    • Foreign nationals who are in H-1B status and are requesting an amendment, change of status, extension of status, or change of employer.
    • Foreign nationals of these petitions will NOT be considered subject to the payment if he or she departs the U.S. and applies for a visa based on the approved petition. 
      • The Proclamation does not impact the ability of any current H-1B scholar holding a valid H-1B visa to travel to or from the United States.

Current or Upcoming International Travel: 

Although the Proclamation does not prevent current H-1B visa holders from traveling in and out of the United States, we continue to recommend that all of our international scholars reconsider any international travel at this time. If you are outside of the U.S. now, or are planning to travel internationally, please contact us at issc@unlv.edu to discuss your specific situation.

If you must travel internationally, we recommend that you also bring copies of the announcement linked below with you out of an abundance of caution:

Important Document Reminders for all H-1B Scholars:

We continue to recommend that you carry your physical immigration documents with you at all times, including here in Las Vegas and during any domestic travel. We also encourage you to keep photos of these documents accessible on your cell phone and computer, with printed copies stored at your residence as an added precaution. These include:

  • Valid passport
  • Most recent H-1B visa, even if expired (Canadians are exempt)
  • Current I-797 A/B Approval Notice
  • Most recent I-94
