AGREEMENT AND RELEASE

This Agreement and Release is made and entered into this _________ day of ____________________________, __________, by and between the Board of Regents of the Nevada System of Higher Education on behalf of the University of Nevada, Las Vegas, ("UNLV"), and _______________________________________ ("PARTICIPANT").
I.RECITALS
            WHEREAS, UNLV desires to provide educational opportunities abroad for its participants; and
            WHEREAS, PARTICIPANT desires to participate in __________________________ ("Program") under the terms and conditions hereinafter set forth;
            NOW, THEREFORE, in consideration hereof, the parties agree as follows:
II. PARTICIPANT'S OBLIGATIONS

PARTICIPANT shall pay the fees set forth in the brochure attached hereto as Exhibit "A" in a timely manner.
PARTICIPANT shall obtain and maintain health insurance which is satisfactory to UNLV and provides, at a minimum, coverage for the time period of the Program.
PARTICIPANT shall consult with his/her physician in regard to necessary immunizations and any other medical matters relating to PARTICIPANT'S participation in the Program.
If, during his/her participation in the Program, PARTICIPANT becomes incapacitated or otherwise unable to provide consent to medical treatment and advance consent cannot be obtained from PARTICIPANT'S family, PARTICIPANT agrees that medical treatment may be performed when, in the opinion of competent medical personnel, the health or welfare of PARTICIPANT will be adversely affected by any delay. In such event, PARTICIPANT authorizes UNLV's designated representative to grant permission for the necessary medical treatment of PARTICIPANT.
PARTICIPANT understands that UNLV cannot guarantee his/her health and safety while participating in the Program. PARTICIPANT is responsible for acting prudently and exercising caution and common sense at all times.
PARTICIPANT agrees that UNLV is not responsible for any personal injury or loss or damage to property suffered by PARTICIPANT during periods of travel independent of the Program.
PARTICIPANT shall abide by all applicable laws of the country hosting the Program. PARTICIPANT shall also conform to all applicable rules, regulations, and policies of the institution hosting the Program and agrees that failure to so conform may result in the termination of his/her participation in the Program.
By participating in the Program, PARTICIPANT specifically waives any and all claims and causes of action, present and future, against the Board of Regents of the University and Community College System of Nevada, the University and Community College System of Nevada, the University of Nevada, Las Vegas, and their officers, agents or employees arising out of PARTICIPANT's participation in the Program and resulting in the death, dismemberment, disability, physical or mental illness or the loss or destruction of the personal property of PARTICIPANT. PARTICIPANT acknowledges that this waiver is made freely, voluntarily, and under no compulsion.
PARTICIPANT agrees to indemnify and hold UNLV harmless for any financial liability and obligation which he/she personally incurs, and for any injury, loss, damage, liability, cost or expense to the person or property of another which is caused or contributed to by PARTICIPANT during his/her participation in the Program.
PARTICIPANT acknowledges that there are existing and emerging health issues worldwide and will seek professional medical advice prior to participation in the Program. PARTICIPANT will take preventative measures and accepts full responsibility for working with medical professionals to plan for their personal health needs.
PARTICIPANT affirms that he/she has read and fully understood all the materials sent to him/her in connection with PARTICIPANT'S participation in the Program.
PARTICIPANT further affirms that he/she is of legal age and is freely signing this Agreement and release.

III. UNLV'S OBLIGATIONS

UNLV will enroll participants who meet the eligibility requirements of UNLV and the Program and who have paid the appropriate fees in a timely manner.
UNLV will facilitate PARTICIPANT's participation in the Program by processing the documentation necessary for enrollment at UNLV and in the Program and by acting as liaison with the institution hosting the Program.
UNLV will provide the personnel and/or resources required by the Program.
To assist UNLV in processing PARTICIPANT'S eligibility for the Program, PARTICIPANT agrees and authorizes UNLV to review his/her disciplinary records.
Upon satisfactory completion of the Program, UNLV will grant PARTICIPANT the credits earned for participation in the Program.

IV. MISCELLANEOUS PROVISIONS

All lawsuits brought by one party hereto against the other and which are in regard to this Agreement and Release or in any way relating to PARTICIPANT's participation in the Program shall be filed and litigated in a court of competent jurisdiction in the State of Nevada.
This Agreement and Release and all claims and causes of action brought by one party hereto against the other and in any way relating to PARTICIPANT's participation in the Program shall be governed by the laws of the State of Nevada.

IF A PARTICIPANT IS UNDER 21 YEARS OF AGE, PARENT OR LEGAL GUARDIAN MUST SIGN BELOW.
I certify that I am the parent or legal guardian of PARTICIPANT and that I have read the foregoing Agreement and Release. I hereby waive any and all claims and causes of action, present and future, that I might have, both on my own behalf and in my capacity as legal representative of PARTICIPANT, against the Board of Regents of the University and Community College System of Nevada, the University and Community College System of Nevada, the University of Nevada, Las Vegas, and their officers, agents or employees arising from PARTICIPANT's participation in the Program and resulting in the death, dismemberment, disability, physical or mental illness or the loss or destruction of the personal property of PARTICIPANT. I acknowledge that this waiver is signed freely, voluntarily, and under no compulsion.
